DUAL CITIZENSHIP - REPUBLIC ACT 9225 OR CITIZENSHIP RETENTION AND REACQUISTION ACT OF 2003
Republic Act 9225, or the Citizenship Retention and Reacquisition Act of 2003, was passed into law on 29 August 2003. RA 9225 grants natural born Filipinos who have lost their Filipino citizenship through naturalization in a foreign country the opportunity to retain or reacquire their Filipino citizenship.
Requirements and Procedure to Retain/Reacquire Philippine citizenship
As laid out in the Implementing Rules and Regulations, the requirements for those who wish to reacquire or retain their Filipino citizenship are as follows:
1. Duly accomplished application form. This will serve as the applicant’s petition. (Application form is available only at the embassy).
2. Set of seven (7) photographs with royal blue background showing the applicant’s left-side view (1 photo), right-side view (1 photo) and front view (5 photos). If 2” x 2” photo size is not available, regular passport photo size is acceptable.
3. Birth Certificate issued on NSO security paper and authenticated by the DFA or if born abroad, Report of Birth issued by the Philippine Embassy or Consulate with jurisdiction over applicant's place of birth.
4. Certificate of Naturalisation as a Dutch citizen or other documentary proof of acquisition of Dutch citizenship (present original and submit photocopy)
5. Current valid foreign passport (present original and submit photocopy of information page)
6. If still available, latest Philippine passport (present original and submit photocopy of information page)
7. For those with minor children/dependents included in the application, legalized or authenticated Birth Certificate/Report of Birth of minor children/dependents, (present original and submit one photocopy)
8. For applicants who were married, widowed, divorced, or whose marriage has been annulled, (if applicable) please present and submit copy of the appropriate document: Marriage Contract/Certificate of Marriage (if married in the Philippines) or Report of Marriage (if married abroad); Death Certificate of spouse or Court Order of presumptive death (authenticated by DFA); or Report of Divorce/Divorce Decree; or Certificate of Finality of Decision and Court Order/Decision (authenticated by DFA)
Please note that applicants may be asked to submit additional supporting documents in case of discrepancies, etc. After the documents are assessed by the evaluating officer in the Embassy, the applicant will be informed within 5 working days fromt he date of submission of the documents if the application has been approved or not.
If approved, the applicant has to execute an Oath of Allegiance before a consular officer in the Embassy. After taking the Oath of Allegiance, the applicant may choose to apply for a Philippine passport (i.e. 5 days fromt he date of application). Please refer to the requirements for passport renewal (including Oath).
